As holiday shoppers in New York prepare to return gifts, the state's Division of Consumer Protection is reminding consumers to be aware of return policies. According to New York law, retailers are not required to accept returns, but they must post a notice if returns are not allowed. If no return policy is posted, stores must accept returns of unused and undamaged items within 30 days of purchase, provided the consumer has a receipt.

The Division emphasizes the importance of understanding refund terms, which must be clearly disclosed before purchase. Refunds can be issued in cash, credit, or store credit, depending on the store's policy. Consumers should also be aware of any restocking fees that may apply.

Secretary of State Walter T. Mosley stressed the importance of consumers paying attention to return policies to avoid issues. He advised shoppers to keep receipts and packaging, and to request gift receipts when buying gifts. If consumers encounter difficulties with returns, they can file a complaint with the New York State Division of Consumer Protection.

The Division's reminder comes as the State of Retail Returns 2024 report indicates that $743 billion worth of merchandise was returned last year. This highlights the need for consumers to be informed about their rights and store policies during the holiday season.
